OPPOSITION SAYS OYEDE TO GO BACK TO OLDEST MAN SYSTEM, CLAN UNION RESOLUTION, AND THE CLAN COMMITTEE REPORT OF 2016 FOR REFERENDUM.
It is hereby asserted that there is nothing to go back to do with the usiriejor clan committee report to correct for referendum as contained in Jahswill report of 2025..
The Usiriejor report provided for
1) a quarter system, Ifagbe, Enuto, and Ubieni
2). Odiologbo system of a younger age from 45 years
3). Family system of the 3 founding families and recommended the rotation options of
a). the listing of Athuaro Okro and Omogbe in the then current gazette of 2003 and 1978 .
b).tossing of a coin to get the first,second, and third.
COURT ACTION
The clan was sued and did not complete the milestones of the transition as recommended by the usiriejor clan committee of 2016.
The founding families court case was the intervening factor, and the clan nor usiriejor committee can be held liable for inactions .
NOTE THESE AS VERY IMPORTANT
A) The Clan subsequent transition processes after the Clan's resolution for the IMMEDIATE CHANGE FROM THE OLDEST MAN SYSTEM, was stalled by the court action.
It was the founding families that went to court to claim the succession to the stool of Oyede Kingdom
The high court set up an ADR headed by Gen Alex Ogomudia with 5 kings, 2 ex chairmen of LGA, a legal secretary, and 2 other persons with terms of reference.
The ADR's report to the court favoured the change to family system but to start with Chief Gammanier Akporuere as Odiologbo.
Gammanier who was the star plaintiff who got written support to sue to be made the king of oyede,through founding families system had
some persons who are now on the odiologbo side.
They had signed for Gammanier to be the king by the name Osewo of Oyede Kingdom.
The ADR committee wrongly assumed that the incumbent odiologbo (Emasibeta) from the Athuaro family had taken the turn of Athuaro.
The Athuaro family in court argued that late Pa Ologbo and Pa Obofa, the immediate past Odiologbo's from Okro and now Pa Idiareh, were prequalified on the basis of age not on family rotation.
That the new system should start afresh
Consequent upon that, the 3 founding families held several meetings resolved and agreed on the rotation, as contained in the then current gazette of 2003, in the order of Athuaro, Okro and Omogbe families.
In compliance with the court interim order the founding families prepared an MOU and a DECLARATION for succession and presented to a joint meeting as directed by court, with the LAWYER'S WHO APPEARED FOR ALL PARTIES IN THE COURT at the joint meetings in the Oyede Traditional palace .
The mou and declaration were read and signed by the founding families' heads, the clan otota,the clan president General, and the incumbent Odiologbo of Oyede.
The document were filed before the court and having resolved the questions, the reliefs of the founding families, the court was satisfied and after a considered view of all the issues presented before court and the terms of settlement filed by the parties, the court entered a CONSENT JUDGMENT on the 6th of November, 2018.
By orders of court, the clan PG, Otota, and Odiologbo forwarded the judgment and the declaration duly signed to the office of the governor of Delta state in 2018 .
By November 2020, after nearly two years of due diligence, the new gazette was approved and published by the delta stategovernment.
B) worthy of mention is that The 2018 consent judgment was not challenged by the defendants or any interested group, nor the 2020 gazette was challenged until after 5 years when the odiologbo group now spreading falsehood went to court in 2025.
C. The 2016 clan union resolutions for the immediate change from the oldest man concept was applauded in oyede,and known in oyede that a modern system will emerge where a well educated younger person from the age of 45 years shall be installed the Ovie of Oyede.
Worthy of note is fact that clan union resolutions of 2016 is binding and effective, and that's the link to the founding families' suit and consent judgment. of 2018 that ordered the succession to the stool of Ovie of Oyede Kingdom.
D. By the 2020 gazette, Oyede has 3 ruling houses to start the Ovie stool, and the Edio system continues with the most counted senior as the head of the Oyede Council Edio as odiologbo.
E. Without waiting for the decision of court of the action they filed, the odiologno group in installed Pa Othiniga, as odior.
As a view Pa Othiniga having emerged as the consensus candidate of the Odiologbo group, stands a better chance under the new gazette which provides for a dual monarchs.
F. The dual monarchs of Odiologbo as the head of the edio council, and Ovie as the paramount ruler.
Finally, the odiologbo group vows that it is odiologbo forever. But the ovie group says let the courts interpret the laws and rule on the application to set aside the gazette and refrained from the installation of Ovie of Oyede Kingdom pending the outcome of the court decision.
The odiologbo group now resort to destruction of properties led by Akemu and heavily been funded by members in diaspora.
On Wednesday the odiologbo group blocked the public road .
