The Human Rights Committee of the Nigerian Bar Association (NBA), Warri Branch, welcomes the recent statement issued by the Delta State Ministry of Justice regarding the interpretation of Section 29 of the Violence Against Persons Prohibition (VAPP) Law. The Ministry's statement affirms our earlier concerns and warns against any attempt by the police to arrest, detain or harass individuals on the ground of "indecent dressing," which is not contemplated in Section 29 of the VAPP Law.
Background
The Delta State Police Command had earlier issued a public notice warning against "indecent dressing" and citing Section 29 of the VAPP Law, which specifically addresses "indecent exposure." We expressed our concerns about the potential for arbitrary arrests and harassment, given the subjective nature of "indecent dressing" and the clear distinction between this term and "indecent exposure" as contained in the Law.
Ministry of Justice's Clarification
We commend the Delta State Ministry of Justice for issuing a statement clarifying that "indecent dressing" is not a crime under Section 29 of the VAPP Law. The Ministry's statement serves as a timely reminder of the importance of accurate interpretation and application of the law.
Police Command's Response
We also appreciate the Delta State Police Command's response to the Ministry's statement. Through its Public Relations Officer, the Command has assured the general public that it will adhere to the Ministry's statement and acknowledge the apparent error in the interpretation of the provisions of the VAPP Law. This demonstrates a commitment to upholding the rule of law and protecting citizens' rights.
NBA Warri Branch's Position
The NBA Warri Branch Human Rights Committee reiterates its commitment to promoting and protecting human rights in Delta State. We will continue to monitor the situation and ensure that the police and other law enforcement agencies adhere to the law and respect citizens' rights.
Call to Action
We urge the general public to be aware of their rights and to report any instances of harassment or abuse by law enforcement agencies. We also call on the Delta State Police Command to ensure that its officers are properly trained on the application of the VAPP Law and other relevant statutes.
