The Ogun State High Court in Sagamu has issued an interim order restraining the Ogun State Government and its agents from demolishing or interfering with properties owned by former Governor and current Ogun East Senator, Otunba Gbenga Daniel.
The ruling, delivered on August 12, 2025, follows an ex parte application filed by Daniel and his wife, Yeye Olufunke Daniel, in response to demolition notices issued by the state.
In his ruling, Justice O.S. Oloyede barred the defendants, their allies, proxies, assigns, cronies, and any persons acting on their behalf from carrying out any demolition, enforcing the quit notice issued on August 8, 2025, or otherwise interfering with the claimants’ possession of the properties.
The order prohibits Governor Dapo Abiodun, the Ogun State Attorney General, the State Planning and Development Permit Authority, and the Commissioner for Physical Planning and Urban Development, along with their agents, from tampering with or trespassing on the properties until the hearing of an interlocutory injunction scheduled for August 19, 2025.
The matter was adjourned to August 19, 2025, for the hearing of the application for an interlocutory injunction.
Recall that Daniel had accused the state government of planning to demolish his properties under the Ogun State Urban and Regional Planning and Development Law No. 61 of 2022, despite claiming the buildings were legally constructed before the law came into effect. He alleged that the move was politically motivated and showed a blatant disregard for due process and the rule of law.
